By accessing or using the Flyercooker App (“Service”), you acknowledge that you have read, understood, and agree to comply with these Terms and Conditions (“Terms”). If you do not agree, you must refrain from using the Service.
1. User Eligibility and Usage Guidelines
The Service may only be used for lawful business promotion and marketing purposes.
You must be an authorized representative of the business you register.
Misuse of the platform, including resale, unauthorized access, data scraping, or reverse engineering, is strictly prohibited.
2. Subscription Plans and Payment Terms
All subscriptions are prepaid and billed based on your selected plan (monthly, quarterly, or yearly).
Access to the Service is activated upon successful payment confirmation.
Free trials, if provided, may include limited features or watermarked outputs.
Pricing and plan details may be revised periodically. Any major changes will be communicated via email or in-app notifications.
3. Refund Policy
Refunds are available within 2 days of purchase—no questions asked.
After this period, no refunds will be processed.
Ellanext Group reserves the right to suspend or deny access in cases of non-payment or fraudulent activity.
4. Content and Brand Ownership
All software, templates, content, and design materials within Flyercooker App remain the exclusive property of Ellanext Group.
Users are granted limited rights to use flyers created through the app solely for their own business promotions.
Copying, redistributing, or reselling app assets or code is strictly prohibited.
5. User Submissions
You retain ownership of your uploaded content (e.g., product photos, text, or designs).
By uploading, you grant Ellanext Group a non-exclusive, royalty-free license to store, process, and display the content to operate and improve the service.
Uploaded content must not infringe on third-party rights, violate any law, or contain offensive or harmful material.
6. User-Uploaded Contact
If you upload customer contact details (e.g., phone numbers or lists), you confirm you have obtained proper consent to contact those individuals.
Flyercooker App uses this data solely to facilitate your marketing activities, such as sending flyers via WhatsApp.
Aggregated or anonymized insights may be used to enhance product performance.
You can delete your contact lists at any time from your dashboard.
All contact data is handled per the Digital Personal Data Protection Act, 2023 (India).
7. User-Generated Media
Users may upload images, graphics, or creative assets for flyer generation. By doing so, you confirm that:
You hold the necessary rights or permissions to use the content.
You authorize Ellanext Group to process and display it for the purpose of flyer creation.
The content does not infringe any copyright, trademark, or intellectual property of others.
Ellanext Group is not responsible for verifying uploaded content and assumes no liability for violations.
We reserve the right to remove any content found or reported as illegal, inappropriate, or infringing.
8. Account Suspension and Termination
Accounts violating these Terms or engaging in misuse may be suspended or terminated without prior notice.
Upon termination, user access will cease, and data may be deleted according to our retention policy.
9. Limitation of Liability
The Flyercooker App is provided “as is” without warranties of any kind, expressed or implied.
Ellanext Group will not be liable for indirect, incidental, or consequential damages arising from use of the Service.
Your sole remedy in any dispute is account cancellation or refund as per the refund policy.
10. Modifications to Terms and Conditions
These Terms may be updated periodically. Significant changes will be communicated via email or app notification.
Continued use of Flyercooker App after updates indicates your acceptance of the revised Terms.
11. Applicable Law and Dispute Resolution
These Terms are governed by the laws of India.
Any disputes shall be resolved through arbitration in Kochi, Kerala, India.
